Paid services are governed by a separate service agreement (MSA / SOW or order form).

Nothing on the Sites is advice or a guarantee of leads, sales, revenue, rankings, cost per lead (CPL) or return on ad spend (ROAS).

Agreement

By using earlinkcrm.com, earlinkads.com, or related Earlink marketing sites (the "Sites"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Sites.

Who we serve

Earlink provides business services (advertising management and CRM-related services) to businesses. Site content is informational and does not create a client relationship until a signed agreement says so.

No advice or results guarantees

Site content is not legal, financial, medical or other professional advice. We do not guarantee leads, sales, revenue, rankings, CPL or ROAS. Advertising and CRM results vary by market, offer, budget, tracking, creative, and how your business handles the leads it receives. Any examples are illustrative only.

Site use

You may browse for lawful business purposes. You agree not to misuse forms, scrape or disrupt the Sites, submit unlawful or misleading content, impersonate others, or attempt unauthorized access. We may suspend access for abuse or security risk.

Accounts and submissions

You are responsible for information you submit through forms. Do not submit health, patient or other sensitive personal information through public forms. You represent you have authority to contact us on behalf of your business. Form submission authorizes us to contact you about your request, including phone/SMS when you check the consent box.

Intellectual property

Site text, design, logos, and materials are owned by Earlink or its licensors. You may not copy or reuse them for competing services without written permission except as allowed by law. Feedback you send may be used by Earlink without obligation to you.

Third-party tools

We may use or reference third-party platforms (ad networks, CRM/hosting providers, analytics). Their terms and privacy practices apply to their services. Earlink is not responsible for third-party outages or policy changes.

Disclaimers

THE SITES AND PUBLIC CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARLINK IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR LOST-PROFIT DAMAGES ARISING FROM SITE USE. FOR SITE-USE CLAIMS ONLY, TOTAL LIABILITY IS LIMITED TO USD $100. Paid-service liability is governed by the applicable MSA/SOW.

Indemnity

You agree to indemnify Earlink against claims arising from your misuse of the Sites or unlawful submissions, to the extent allowed by law.

Governing law

Laws of the State of Florida, excluding conflict-of-law rules. Venue: Miami-Dade County, Florida (principal address Miami, FL), unless a signed service agreement says otherwise.

Changes

We may update these Terms. Continued use after changes means you accept the updated Terms.
